The European Court of Justice annulled agreements reached in 2004 between European and U.S. authorities regarding transmission of airline passenger data
from European carriers to U.S. Customs and Border Protection. The Court said the agreements were neither "adequate" nor "founded on an appropriate legal basis" and scheduled annulments to take effect 30 Sept 2006. The United States government previously threatened to penalize or ban foreign airlines not transmitting passenger name records.
