As an appeals court considers a new challenge to New York State's airline consumer protection law, the . DOT cited the Airline Deregulation Act, which stipulates that "States may not enact or enforce a law, regulation, or other provision having the force and effect of law related to a price, route, or service of an air carrier." DOT submitted a "clarification" to its
notice of proposed rulemaking on air consumer protections, first published in November. It now is reviewing public commentary regarding its proposals.
